The article discusses the issue of the Rules of Procedure of the Sejm as part of the legal order in Poland. The aim of this article is to assess the correctness of establishing and applying the Rules of Procedure of the Sejm and its place in the hierarchy of sources of law in Poland. The author begins his considerations with a historical analysis of the rules of procedure of the Sejm. Then he goes on to present the principle of parliamentary autonomy, which gives the Sejm the right to decide on its own matters, and the Rules of Procedure of the Sejm are treated here as a manifestation of this principle. The following section considers the issue of the place of the Rules of Procedure of the Sejm in the hierarchy of sources of law and attempts to classify this legal act in one of two categories – generally or internally binding law. The article ends with a discussionof the review of the constitutionality of the rules of procedure of the Sejm.
The considerations in the article were based on case law, doctrine, regulations and constitutional legislation.
