Water companies are non-public forms of organization. They have special features that do not allow them to be identified with the organizational forms characteristic of commercial or civil law. Their activities in the area of maintenance and operation of water irrigation and drainage devices bring benefits not only to members but also to entities that are not members of the company. A starost determines the amount and type of fees that non-members pay to the company. Applicable law does not specify the method of calculating the amount of these fees. Case law applies to these issues to a limited extent only. It is therefore necessary to analyze provisions and case law, and then propose appropriate legislative changes.
