The content of this article focuses on the EU conditions for implementing the idea of rational ecological waste management with the use of insurance institutions, such as an insurance contract or guarantee. An attempt is made to define the notion of waste/product and forms of waste management. In order to demonstrate the importance of the financial security imposed by EU legislation, it proved necessary to present this obligation in the context of the broader principles: polluter pays and the principle of extended producer responsibility. The impact of EU legislation on national legal systems was presented using the example of Poland – Polish legislation and the Polish insurance market.
