Abstract

The analysis argues that lawyers in Europe face a doctrinal war on multiple fronts with the basic tenets of the Treaties and the European legal system on the line and at stake. Looking at the processes around us with which we have been faced this year, their common characteristic is the arbitrary and unpredictable character of what has been done. It is this that it is the duty of the lawyer to challenge and of the judge to strike down.
