Kultura prawna i kultura polityczna w procesie stanowienia i stosowania Konstytucji RP
Abstrakt
The Author analyzes the influence of legal culture and political culture on the process of establishing and applying the Constitution of the Republic of Poland. The Constitution was passed in 1997 by the National Assembly, dominated by centro-leftist forces (almost 35% of right-wing votes were not present in the structure of the Assembly, because the parties did not exceed the 5% electoral threshold). Efforts to build a political consensus „beyond divisions” did not bring success. On the one hand, the constitutional referendum legitimized the Constitution, but at the same time it exposed the deep political division.
