Wolność sumienia i wyznania w Konstytucji Rzeczypospolitej Polskiej
Abstrakt
Freedom of conscience and confession is one of the fundamental personal freedoms and rights in the catalogues of modern constitutions. The possibilities of its usage and guarantees belong to the canons of contemporary democracy. Without any doubt, it is a significant value of the constitutions and political systems of modern democratic states. Its concept and scope derive, first and foremost, from the output of the doctrine, international and European law, as well as the judicature of national, international and supranational courts, including constitutional tribunals, which role in this matter is hard to overestimate. The paper aims at analyzing the notion of the freedom of conscience and religion which has been conceptualized in the Polish basic law under the influence of the constitutional law doctrine, as well as the highest international, supranational and judicial standards.
