Sądy – po zmianach
Abstrakt
The judicial branch in Poland has been, since 2015, submitted to the dramatic process of transformation and degradation. The Author discusses, first, the principal characteristics of changes in the composition and organization of the Constitutional Tribunal, the National Council of Judiciary and ordinary courts. Furthermore, it is considered what future effects of these changes might be. In particular, to what extent they may affect the court’s impartiality and independence and, in consequence, the authority and finality of judicial decisions. Another important area of uncertainty relates to future reactions of both highest courts of Europe: ECtHR and CJEU. Finally, the Author addresses the future of the judicial review in Poland and the question of possible marginalization of the future role of the Constitutional Tribunal.
