Friendly settlement proceedings and prevention of expiration of time-limits

Abstract

The commentary concerns the issue of bringing a motion to call parties to the proceedings to attempt to reach friendly settlement and its effects on the time-limit to bring a claim before a court. In the commentary, main case-law on the subject is presented, with particular concern to the most important issues of the subject. Moreover, the effects of the friendly settlement proceedings on the position of the parties to the proceedings have been analysed. An important part of the commentary consists of the analysis of expiry of time-limits from the perspective of rights abuse.
