Abstract

Ship recycling is an integral segment of maritime governance. It is also economically justified. On the other hand, it is associated with a real threat to human life and health, as well as the environment, especially if there is no legal framework regulating the scrapping process. This problem has been recognized internationally, resulting in the adoption of the International Convention for the Safe and Environmentally Sound Recycling of Ships, which is the most comprehensive possible response to the challenges of ship recycling. If the Convention comes into force, it will radically change the legal situation and the obligations of the shipowner and others regarding the design, construction, operation, and recycling of ships. As a consequence, it will lead to a significant reduction of the risks to human health and life and the environment. At present, the condition regarding the number of ratifications, which is seventeen out of the fifteen required, has been met. Unfortunately, 10.23% of the world’s gross tonnage is missing for the Convention to enter into force.
