The commented ruling concerns a dispute as to whether the validity of a declaration of waiver or acceptance of inheritance requires only compliance with the requirements as to the form provided for in the state of habitual residence of the person submitting such declaration, or whether it is necessary to comply with certain requirements as to form, which arise from law inheritance court. This issue arose in connection with the well-established position of German doctrine, excluding the question of the addressee from the scope of the form of a declaration. Although the legal question presented by the referring court concerns the issue of the form of a declaration under the national law of one of the Member States, the answer already given by the Court of Justice to it is universal and introduces a uniform interpretation of the content of art. 13 e.r.s. in connection with art. 28 b) e.r.s.
