Rola Ministra Obrony Narodowej w cywilnym modelu zwierzchnictwa nad Siłami Zbrojnymi RP
Abstrakt
In modern democracies, civilian control over an army is essential to ensure respect for human rights, the rule of law, and the implementation by the armed forces of the basic tasks of the state. It requires the construction of a legal framework clearly defining the powers of the head of state, government, parliament, courts and armed forces as regards defense issues both during peacetime and during armed conflicts, taking into account the principle of division and balance of powers and defining the rights and obligations of members of the armed forces. In the light of the current constitutional regulation, the Minister of National Defense plays a key role in the civil system and democratic control over the Armed Forces. This article aims to discuss the role of the head of the Ministry of National Defense in the model of the civilian oversight of the Armed Forces.
