Right of a probation officer to complain about court orders in enforcement proceedings

On the basis of the Executive Penal Code of 1997 the role of a probation officer has increased significantly. He has become a body of executive proceedings that takes active part especially in the execution of the penalty of community service, as well as measures related to probation and parole. As a body of executive proceedings, he makes decisions related to the execution of spe- cific penalties, he also has the right to submit motions initiating incidental proceedings before a court. The problem, however, is that the wide catalog of cases in which a probation officer may institute proceedings in a court is not fully consistent with the right to lodge a complaint against court orders in enforcement proceedings. The article is devoted to this issue.
