Law applicable to liability for environmental damage under the Rome II Regulation

Abstract

The legal norms of the private international law on the law applicable to environmental damages are codified in the Rome II Regulation on the law applicable to non-contractual obligations. The uniform rules of this regulation and the special regulation contained therein concerning environmental torts duly implement the objectives and tasks of private international law in this area. This regulation ensures a reasonable balance between the interests of the person claimed to be liable and the person who has sustained damage, taking into account the requirement to strive to ensure a high level of environmental protection.
