Konsekwencje naruszenia wartości Unii Europejskiej na przykładzie unicestwienia polskiego Trybunału Konstytucyjnego w 20 lat po uchwaleniu Konstytucji RP

Abstrakt

The article is devoted to the phenomenon of the breach of the European Union’s values by a Member State. Changes in the functioning of the Polish Constitutional Tribunal initiated by Polish authorities in 2015 have been considered to be inconsistent with EU values. The article aims to identify the causes and effects of the authorities’ actions towards Polish Constitutional Tribunal, as well as the consequences of the breach of the Union’s values by Polish authorities in regard to changes in the functioning of the Constitutional Tribunal. The analysis of the Constitutional Tribunal’s jurisprudence on selected „European affairs” confirms that from the beginning of the Poland’s membership in the European Union rulings related to European Union law have been evoking exceptional emotions which will result in specific political decisions in the future.
